Important Information about Laws and Your Role as an ACC
This handbook is designed to help you become a great Community Associate Chaplain (CAC). It provides information and resources, but it can't replace knowing the laws in your area.
Here's the bottom line: You are responsible for following the laws of your country and any specific location where you serve as an CAC.
Why? Laws can be different from place to place. What's okay in one area might not be okay in another.
We can't be your lawyer: While we made this program with the best info available, laws can change. We can't guarantee everything here is 100% up-to-date, nor are we responsible if something goes wrong because of the information in this handbook.
What you can do to stay safe:
We're here to help, but legal stuff is best left to the experts!
Disclaimer of Liability and Independent Contractor Status
1. Independent Contractors: The Community Associate Chaplain (CAC) program equips individuals to provide spiritual and emotional support within the community. All CACs participating in the program are considered independent contractors. This means they are not employees of our organization and are not entitled to employee benefits such as health insurance, unemployment compensation, or workers' compensation.
2. Responsibility for Conduct: CACs are solely responsible for their own actions and conduct while serving in the community. Our organization is not liable for any negligent acts, errors, or omissions committed by an CAC in the course of their independent service.
3. Code of Conduct: While CACs are independent contractors, we expect them to adhere to a high standard of professional conduct. A copy of our Code of Conduct for CACs will be provided to all program participants. This code outlines ethical behavior, respect for diverse perspectives, confidentiality, and maintaining appropriate boundaries.
4. Background Checks: All applicants for the CAC program will undergo a background check to ensure suitability for the role.
5. No Guarantee of Placement or Services: Participation in the CAC program does not guarantee placement in a specific role within the community. CACs are responsible for securing their own service opportunities. Additionally, our organization cannot guarantee the quality or outcome of any services provided by CACs.
6. Disclaimer of Warranties: The information and training materials provided in the CAC program are offered "as is" and without warranties of any kind, either express or implied. Our organization disclaims all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability: In no event shall our organization be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the CAC program or the services provided by CACs. This includes, but is not limited to, damages for personal injury, emotional distress, property damage, lost profits, or loss of business opportunities.
8. Governing Law: This disclaimer shall be governed by and construed in accordance with the laws of the State of Florida.
9. Entire Agreement: This disclaimer constitutes the entire agreement between you and our organization with respect to the CAC program and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
10. Severability: If any provision of this disclaimer is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
11. Right to Modify: Our organization reserves the right to modify this disclaimer at any time without prior notice.
By participating in the CAC program, you acknowledge that you have read and understood this disclaimer and agree to be bound by its terms.
